This Privacy Policy explains how PopWheels, Inc. (“PopWheels,” “we,” “us,” or “our”) collects, uses, shares, and protects information in connection with your use of our battery-swap network, the PopWheels mobile application, our websites (including popwheels.energy and popwheels.club), and related services (collectively, the “Service”). This Policy supplements Section 9 (Privacy) of our Membership Agreement and is intended to be read alongside it.

If you do not agree with this Policy, please do not use the Service. By creating an account or using the Service, you agree to the collection, use, and disclosure of information as described here.

1. Information We Collect

1.1 Personal Information

When you create an account or use the Service, we may collect:

•      Name, phone number, and email address

•      Government-issued photo identification, where required for membership eligibility

•      Account credentials and membership status

•      Communications you send us, including support requests and SMS messages exchanged with the Service

1.2 Financial Information

To process membership fees, initiation fees, late fees, and damage or replacement charges, we collect:

•      Credit card, debit card, or other payment method details

•      Billing address and transaction history

•      Payments may be processed by third-party payment processors (e.g., Stripe). We do not store full payment card numbers on our own servers.

1.3 Messages

We collect the content of messages you send through the Service, including SMS messages used to locate stations or check out batteries, and messages sent to customer support. These may be used to operate the Service, respond to your requests, and improve our SMS and support systems.

1.4 Location Information

As described in Section 9.2 of our Membership Agreement, we may collect:

•      Your device's precise location (GPS and WiFi-based) when you use the Service

•      IP address and Bluetooth data used to connect to battery cabinets

•      The precise location of Popwheels batteries, independent of your device location

1.5 Information Collected Automatically

•      Device identifiers, operating system, and app version

•      Usage data such as swap history, station visits, and session activity

•      Log data including access times and crash reports

2. How We Use Information

We use the information described above to:

•      Provide, operate, and maintain the Service, including processing battery swaps and payments

•      Verify member eligibility and identity

•      Communicate with you, including service announcements, administrative messages, and support responses

•      Detect, investigate, and prevent fraud, abuse, or violations of our Membership Agreement

•      Maintain and improve the Service, including station placement and battery availability

•      Market the Service to you, where permitted; you may opt out of certain marketing communications

•      Comply with legal obligations, including tax, safety, and regulatory requirements

3. How We Share Information

3.1 Third-Party Service Providers

We share information with vendors who perform services on our behalf, including payment processing, SMS and messaging delivery, customer relationship management, and data storage. These providers are authorized to use your information only as necessary to provide services to us.

3.2 Financial Information and Messages

Consistent with our Google Play Data Safety disclosure, financial information and message content may be shared with third parties strictly to process transactions (payment processors) and deliver communications (SMS/messaging providers). We do not sell your financial information or message content to third parties for advertising purposes.

3.3 Third-Party Services

Certain features of the Service may integrate with third-party websites, services, or platforms (“Third-Party Services”). We may share information about your use of the Service with these Third-Party Services. PopWheels makes no representation regarding, and accepts no responsibility for, the privacy practices of Third-Party Services.

3.4 Legal and Safety Disclosures

We may disclose information where required by law, regulation, legal process, or governmental request, or where we believe disclosure is necessary to protect the rights, property, or safety of PopWheels, our members, or the public.

3.5 Business Transfers

If PopWheels is involved in a merger, acquisition, financing, or sale of all or substantially all of its assets, information may be transferred as part of that transaction, consistent with Section 12.7 of our Membership Agreement.

3.6 SMS / Text Messaging Program

If you opt in to receive text messages from Popwheels (including station location alerts, battery checkout confirmations, and account/support messages), the mobile phone number you provide and your consent to receive messages will not be sold, rented, or shared with third parties for their own marketing or promotional purposes. Your phone number and SMS consent status may be shared only with our SMS/messaging service providers (e.g., Telnyx) strictly to deliver the Service, and are never shared with third parties for marketing purposes. 4. Data Security

We use industry-standard safeguards to protect your information, including encryption of data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

5. Data Retention and Deletion

We retain information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

Your right to request deletion: You may request that we delete your personal information by contacting us at contact@popwheels.energy. We will honor deletion requests except where we are required to retain information for legal, tax, safety, or fraud-prevention purposes.

6. Your Choices

•      Location data: You can disable location services for the PopWheels app at any time through your device settings or the app's account privacy section, though this may limit your ability to locate nearby stations.

•      Marketing communications: You may opt out of certain promotional messages as described in the communication itself or by contacting us.

•      Account information: You may request access to or correction of your personal information by contacting us.

7. Children's Privacy

The Service is not directed to individuals under 18. Consistent with Section 2 of our Membership Agreement, members must be at least 18 years of age. We do not knowingly collect personal information from anyone under 18.

8. International Users

The Service is currently operated primarily in the United States and Canada. If you access the Service from outside these regions, your information will be transferred to and processed in the jurisdictions in which we and our service providers operate.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the “Last Updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.

This Privacy Policy is intended to supplement, and should be read together with, Section 9 (Privacy) of the Popwheels, Inc. Membership Agreement available at popwheels.club/terms. In the event of a conflict between this Policy and the Membership Agreement regarding privacy practices, this Policy shall govern.
